Unless required by applicable law or agreed to in writing, AfricaRice provides RiceAdvice on an "AS IS" basis, without warranties or conditions of any kind, either express or implied, including, without limitation, any warranties or conditions of title, non-infringement, merchantability, or fitness for a particular purpose. Users shall be solely responsible for determining the appropriateness of using or redistributing RiceAdvice and assume any risks associated with the application of RiceAdvice and use of its recommendations.
In no event and under no legal theory, whether in tort (including negligence), contract, or otherwise, unless required by applicable law (such as deliberate and grossly negligent acts) or agreed to in writing, shall AfricaRice or Co-Capacity BV, its employees or representatives be liable to any user for loss, damages, injury or death, including any direct, indirect, special, incidental, or consequential damages of any character arising as a result of the use of RiceAdvice or inability to use RiceAdvice (including but not limited to damages for loss of goodwill, work stoppage, computer or device failure or malfunction, or any and all other commercial damages or losses), even if AfricaRice has been advised of the possibility of such damages.
RiceAdvice will collect personal information from user and beneficiary, including name, email address, phone number, village name, crop management practices, crop area, crop yield and inputs used for crop production, for proper functioning and to provide the beneficiary with a recommendation/advice.
From time to time, AfricaRice may use personal information collected through RiceAdvice to send important notices, such as SMS reminder messages to underpin the recommendation or to provide additional information of relevance to the user. AfricaRice also uses personal information for data analysis and research to improve RiceAdvice. Aggregated, anonymized data will be used in scientific papers and shown in statistical representation formats on the RiceAdvice website.
No personal information will be shared with third parties for their marketing purposes. However, it may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for AfricaRice to disclose personal information.
